Community Quarantine Violators in Caraga nearly reach 4,000

Camp Col Rafael C Rodriguez, Butuan City—-Police Regional Office (PRO) 13 recorded an over-all total of 3,977 community quarantine violators since its implementation in Caraga region last March 17, 2020 until yesterday, May 24.

Police Brigadier General Joselito T Esquivel Jr, Regional Director, said that out of the total number of violators, 2,686 were apprehended for violating curfew hours, 1,237 for disobedience to a person and/or agents of person in authority, 52 for hoarding, profiteering, overpricing of medical supplies and essential goods while another 2 were also apprehended for violating guidelines on PUVs during quarantine period.

The region’s top cop further disclosed that 345 of the arrested persons have undergone inquest proceedings, 1,124 will be subjected for regular filing, 222 were fined while the remaining 2,286 were given warnings and have undergone counseling.

Last April 5, 2020, in Bayugan City, Agusan del Sur, three individuals were arrested and one Ford Ranger Wildtrak Pick-up bearing Plate Number C2 T981 was impounded for unauthorized use of siren/blinker and for intentionally ignoring and disobeying two Quarantine Command Post Checkpoints established along National Highway of Brgy. Wawa and crossing RCA, Brgy. Poblacion, of said city.

The region’s top cop identified the arrested persons as:

(a) Arthur Aguillon Bernardo with LTO PDL No. K01-02-045431, 33 years old, single, businessman, and a resident of Purok 4, Brgy. Villa Kananga, Butuan City;

(b) Nico Ecol Porras, 30 years old, chief mechanic, single with live-in partner and a resident of Purok 6, Brgy Silad, Butuan City; and

(c) Jonathan Amancio Parcon, 36 years old, laborer, single and a resident of Purok 1, Brgy Santa Teresa, Loreto, Agusan del Sur.

A case for Disobedience to Agent of Person in Authority has been filed against the three violators last May 18 with NPS Docket No. XIII-09-INV-20E-090.

In addition, request for revocation of driver’s license issued to Arthur Aguillon Bernardo and cancellation of registration of his driven motor vehicle have already been submitted at the Land Transportation Office 13 for violation of Presidential Decree 96 as amended to R.A. 4136 (Land Transportation and Traffic Code), Article IV, Section (b1) which states that “All authorized emergency vehicles, such as ambulance and police cars and fire wagons used for emergency calls shall be equipped with a bell, siren, or exhaust whistle of a type approved by the Commissioner, and no such device shall be installed or used in any other vehicle.”

“Let this serve as stern warning to those who will violate the law. Police Caraga will remain relentless in enforcing the guidelines and protocols within the bounds of the law and will send the violators behind bars. We continue to call on public for cooperation as this war against corona virus disease 2019 will be far from over if the public remains uncooperative with the authorities,” PBGEN Esquivel, Jr said.

PNP Caraga records ZERO sexual abuse complaint against Policemen manning quarantine checkpoint

Camp Col Rafael C Rodriguez, Butuan City—-Police Brigadier General Joselito T Esquivel, Jr, Regional Director of Police Regional Office (PRO) 13, released in a statement today, May 25, that PNP Caraga has received ZERO complaint against police frontliners manning the established Community Quarantine Control Points (CQCP) in the region, after alleged sexual abuses against women has been committed by policemen in other region amid the quarantine period.

Record from Regional Women and Children Protection Desk (RWCPD) reveals that since the start of quarantine period in Caraga on March 17, 2020, their Office has not received any complaint against Caraga cops manning the control points for committing any form of sexual abuses.

The Philippine National Police, as one of the members of Inter-Agency Task Force for the Management of Emerging Infectious Disease, are among those personnel manning the CQCP along with the personnel from the Department of Health, Armed Forces of the Philippines and Bureau of Fire Protection which was established in line with government’s fight against corona virus disease 2019, or COVID19.

Police General Archie Francisco F Gamboa, Chief of Philippine National Police, issued a statement earlier encouraging victims of alleged sexual abuses to file complaints against erring Police Officers who committed sexual abuses against women and emphasized that the PNP organization will never tolerate any form of physical or sexual abuse against women especially now that we are facing a global health crisis.

“If you have any complaints against our policemen committing sexual abuses in quarantine control points in the region, you may immediately report to Women and Children Protection Desk at your local police station. Rest assured that your reports and complaints will be given appropriate action and corresponding penalty will be given to Police Officers who will be proven to have committed such malicious acts,” PBGEN Esquivel, Jr said.

Info from former rebels, intel community leads to capture of wanted NPA

Camp Col Rafael C Rodriguez, Butuan City——— The tip provided by the former rebels and the Barangay Intelligence Network led to the arrest of a wanted NPA member in the town of Esperanza, Agusan del Sur around 9:00AM today, May 23.

Police Regional Office (PRO) director Brigadier General Joselito T. Esquivel, Jr., disclosed that Ispan J. Tumanan a.k.a Donie, 28 years old, resident of Brgy. Remedios, Esperanza, Agusan del Sur was captured in his residence by the operatives of the Regional Intelligence Unit 13 and Esperanza Municipal Police Station.

He has standing warrant of arrest for Kidnapping and Serious Illegal Detention under Criminal Case No. 6527 and 6525 issued by Honorable Judge Hon. Fernando R. Fudalan Jr of 10th Judicial Region, RTC Branch 7, Bayugan City, Agusan del Sur with no bail recommended.

Based on the investigation, the suspect is a member of Weakened Guerilla Front 88, North Central Mindanao Regional Committee operating in the areas of Agusan del Sur and west of Agusan River.

Tumanan was one of the NPA terrorists who attacked the New Tubigon Patrol Base in Sibagat, Agusan del Sur on December 19, 2018. The group kidnapped two Army soldiers and 12 members of the Civilian Armed Forces Geographical Unit (CAFGU).

“Our intelligence monitoring is underway to arrest his other cohorts. We will make sure they will face the full wrath of the law because Kidnapping and Serious Illegal Detention is punishable under Art. 267 of the Revised Penal Code,” RD Esquivel, Jr added.

13 victims including 12 minors rescued in Butuan City cybersex den

Camp Col Rafael C Rodriguez, Butuan City—-The authorities have successfully rescued 13 victims including 12 minors during an entrapment operation and implementation of Search Warrant in a cybersex den in Purok 5 Barangay Ambago, Butuan City, Agusan del Norte just this morning, May 21.

During the operation 13 victims including one adult and 12 minors were rescued. Four of the victims are 1 to 3 years old who were considered as Children at Risk. While the other nine victims are 11 to 19 years old who were forced to engage in sexual acts in exchange for monetary payment in the amount of Php2, 000.00, Php5, 000.00 up to maximum of Php20, 000.00 depending on the kind of “show” requested by the online client both from Philippines and abroad.

The operating troops are composed of PNP personnel from Women and Children Protection Center – Mindanao Field Unit, Regional Anti-Cybercrime Unit of Region 10 and Region 13, Regional Intelligence Division 13, Regional Women and Children Protection Desk 13 and Butuan City Police Office together with the Department of Social Welfare and Development (DSWD) Caraga, Department of Justice (DOJ) Regional Inter-Agency Council Against Trafficking (RIACAT) 13, Regional Anti-Trafficking Task Force (RATTF) 13 with the active support of International Justice Mission (NGO); Australian Federal Police and Justice, Peace & Integrity of Creation-Integrated Development Center, Inc.

The authorities implemented Warrant to Search, Seize, Examine Computer Data (WSSECD) and Rescue Operation on Online Sexual Exploitation of Children (OSEC) with SW No. 2020-2078 against the female suspect, 28 years old, female, single and a resident of Purok 5, Barangay Ambago Butuan City, for Child Pornography committed through a computer system or violation of Section 4 (c) (2) of R.A. 10175 also known as “The Cyber-Crime Prevention Act of 2012” issued by Honorable Isam J Echem-Tangonan, Issuing Judge of Branch 33, Regional Trial Court, 10th Judicial Region, Libertad, Butuan City dated May 20, 2020 which resulted in the successful arrest of the subject of operation including her live-in-partner for conspiracy.

Women and Children Protection Center – Mindanao Field Unit revealed that they started conducting surveillance and case build-up against the suspect since December of 2019 through conduct of constant cyberspace patrolling.

During conduct of search, the operating troops recovered pieces of evidence of the crime such as assorted cellphones, assorted identification cards, remittance cards, MLhuillier Receipts, Palawan Receipts, Cebuana Lhuillier Receipts, lubricant, tablet and router.

The operating personnel also recovered in plain view four improvised long firearms, 1 replica of caliber 45; one caliber 38 revolver with six live ammunition and bladed weapons which are believed to be owned by the live-in partner of the subject of operation.

Arrested suspects and recovered pieces of evidence were brought to Butuan City Police Station 3 for proper disposition while victims were turned-over to DSWD13 for processing and evaluation.

This WCPC-MFU is preparing pertinent documents for filing of cases against the arrested suspects for violations of RA 9208 (Anti-Trafficking in Persons Act of 2003) as amended by RA 10364 (Expanded Anti-Trafficking in Persons Act of 2012), RA 9775 (Anti-Child Pornography Act of 2009), RA 10175 (Cybercrime Prevention Act of 2012) and RA 7610 (Special Protection of Children Against Abuse, Exploitation and Discrimination Act).

“This commendable accomplishment is attributed to the collaborative efforts of all those involved in the major police operation. The PNP, as the prime law enforcement agency of the land, is committed to protect those who are victims of all kinds of abuses especially our young children who are the future leaders of our country,” said PBGEN Esquivel, Jr.

“I encourage all the people of Caraga to help us in the prevention of crimes and ensuring peace and order in the region by immediately reporting to your nearest police station any criminal activities in your locality. Rest assured that your identification will be kept confidential and anonymous,” he added.

Joint PNP-AFP opn result in seizure of explosive, militiaman nab in Kitcharao, Agusan Norte

Camp Col Rafael C Rodriguez, Butuan City—-The joint operating forces of PNP Caraga and 29th Infantry Battalion, Philippine Army successfully arrested an identified Militia ng Bayan (MB) in the municipality of Kitcharao, province of Agusan del Norte and recovery of explosive during the implementation of Search Warrant around 9:00 o’clock in the evening yesterday, May 20.

Armed with Search Warrant No. 2020-114-04 for violations of R.A. 9516 (Illegal Possession of Explosives and Incendiary Device) issued by Hon. Anthony P. Vitor, Acting Presiding Judge 10th Judicial Region 2nd Municipal Trial Court of Tubay-Santiago, Donia Rosario, Tubay, Agusan del Norte dated May 19, 2019, personnel of Kitcharao Municipal Police Station together with 2nd Provincial Mobile Force Company of Agusan del Norte Provincial Police Office and 29IB, PA conducted the operation in Purok 5, Brgy. Mahayahay Kitcharao, Agusan del Norte which resulted in the successful arrest of ESTEBAN CANTOBEROS BASALAN, 57 years old, married, Militia ng Bayan member (MB) under Guerrilla Front 16A, Northeastern Mindanao Regional Committee (NEMRC).

The joint operating forces recovered one unit anti-personnel mine (pipe bomb), one piece six meters electric wire with blasting cap, one piece six meters brown electric wire/leg wire, one piece six meters red and white electric wire/ leg wire, and two pieces rubber wrap.

PBGEN Joselito T Esquivel, Jr, PNP Caraga Director said that implementation of Search Warrant was witnessed by Captain Mario C Magsanay, Kagawad Haine Ladao and Kagawad Orlando Bonita, all are barangay officials of Barangay Mahayahay, town of Kitcharao.

Arrested MB member is now under the custody of Kitcharao MPS for proper disposition while confiscated pieces of evidence will be presented to the issuing court and will be subjected for examinations at the Regional Crime Laboratory Office 13 and PNP EOD Unit.

“I encourage all the active members of CPP-NPA Terrorists and Militia ng Bayan to surrender with the government and avail the Enhanced Comprehensive Local Integration Program (E-CLIP) of the Duterte administration which offers financial assistance and livelihood programs to our brothers and sisters who were once deceived to join the armed struggle but decided to return to the folds of law,” said PBGEN Esquivel, Jr.
